Cllr Joyce Lucas Trees and the problem with Oakham Town Council

When the tree branch fell in Cutts Close Oakham during storm Doris Cllr Lucas came very
close to making an unlawful decision and was only stopped from doing so when she sent
all members of the council a email mine was sent via the office?

The Chairman of the council had to remind her once again she could not just do as she
pleases.

What I find interesting reading her email is how keen she was to see the tree felled on the same
day. But then in public she stands at a meeting calling and states in public
she is for the tree and would not want to see it felled. Cllr Lucas must be getting very confused these days?

I am aware of both trees in Burley Road Car Park...The forestry officer and planning officer are on their way to take photos.
The OTC tree surgeon has sorted the dangerous branch.
I will know later today if we can take down the Lime Tree.....I will take the responsibility of getting the tree felled if I have the say so from RCC. We CANNOT afford to have someone killed.

RCC will sort compensation for the damage to the cars in Burley Road car park.
PLEASE let me know a.s.a.p. if you have any objection top my actions.

No Councillor can authorise this work, it must come from the Office.

Joyce in her capacity as Tree Warden to the Council can advise that there is a RISK.

Which has been done now.

The Office working with a Tree Contractor (I was unaware of an OTC Tree Surgeon) can further establish the urgency and RISK and then the Office agree to engage the appropriate contractors.

Standing Orders and Financial Regulations must be adhered to please by everyone.

Given that a Tree Contractor has attended site and as I am aware they have sated they have made the area safe then I would suggest the Council are exercising due diligence and the Office have this well in hand.

My understanding is that the incident in the carpark is not a Town Council issue.

Thank you to Joyce for her invaluable input, Allison, please pass on the Council thanks to the Contractors involved for their speedy response today as it is becoming very apparent that the County as a whole is having a time of it.

In 2015 Oakham Town Council paid a considerable sum of money to obtain
a survey report for all the trees in the town it was responsible for at the time.

The report was never presented to full council until last week.

Urgent recommendations have not been acted upon by the office.

Cllr Joyce Lucas our tree warden told the council at a previous meeting the report had been
lost and a new one was required I supported her £13,000 budget request
enough funding to obtain a new report. At the last meeting she said I was
not telling the truth. It is fortunate I record all meetings and can prove
Cllr Joyce Lucas is very forgetful.

Cllr Lucas tried to deflect from the fact she and the office had neglected their
responsibilities to ensure the requirements of this report were carried out.
Cllr Lucas felt it was appropriate to read a very defamatory and offensive statement
blaming me for their failings accusing me continually lying and harassing staff and
Councillors over the last two years, (see video)



(yes Cllr Lucas while we are expected to abide by this financial regulation 10.3. All members and Officers are responsible for obtaining value for money at all times. An officer issuing an official order shall ensure as far as reasonable and practicable that the best available terms are obtained in respect of each transaction, usually by obtaining three or more quotations or estimates from appropriate suppliers, subject to any de minimis provisions in Regulation 11 below.  I will continue to ask that
we obtain quotes for all major works and contracts)


At the same meeting it was decided the council no longer needs to obtain three quotes
for any work.

Since the meeting there has been some communication between myself and Cllr Adam
Lowe our Chairman.

His last email he takes one part of our financial regulation and suggests I am misunderstanding it
he rather oddly suggests to the clerk I am in breach of standing orders for pointing out that
the staff would be committing an act of gross misconduct if they breached our financial regulations.
By pointing these regulations he says I am guilty of instigating disciplinary proceedings?

1.6. A breach of these Regulations by an employee is gross misconduct. 

10.3. All members and Officers are responsible for obtaining value for money at all times. An officer issuing an official order shall ensure as far as reasonable and practicable that the best available terms are obtained in respect of each transaction, usually by obtaining three or more quotations or estimates from appropriate suppliers, subject to any de minimis provisions in Regulation 11 below. 


I am not misunderstanding anything what I see is a Town Council that once again is not
interested in obtaining value for money at all times.

Cllr Martin Brookes has submitted a complaint against the Council to myself.
He has also made a request  that disciplinary action against the Assistant Clerk be taken.

Below are extracts from e-mails from Cllr Brookes. You were copied into the originals I believe.



(i)   'disciplinary action against the assistant clerk for gross misconduct for ignoring the financial regs to obtain at least three quotes'

(ii) 'Please accept my complaint about the council refusing to obtain quotes'

Regarding the Council procedures, g) Councillors concerns regarding procedural matters relating to any Council business should be taken up, in the first instance, with the Clerk. Employees concerns may be taken up through the Clerk and / or the Chair of the Council, initially on an informal basis.

Can you look into (ii) above and advise Cllr Brookes of your finding please. Cllr Brookes pointed me toward Financial Regulations 10, my own interpretation is that it states in 10.3 'usually by obtaining three or more quotations'. As such it is not mandatory under our own Financial Regulations. 

In my opinion the Council has not committed any breach of any regulations.

In regard to (i) above, Cllr Brookes has made a general comment without specific detail, as such though my understanding is that he referring to the same issues around quotes and as such the same rule applies and the Assistant Clerk has not breached any of the Councils Standing Orders, Cllr Brookes appears to have predetermined this as he states he wants a disciplinary against the Assistant Clerk.

Cllr Brookes appears to have breached the Council procedures here as they state (c) Any formal disciplinary action will only be initiated by the Clerk or the Full Council /  appropriate committee with delegated powers. No individual Elected Member has the ability to unilaterally initiate formal disciplinary action.


Once again, as Clerk to the Council can you look into this issue and give direct feedback to Cllr Brooks, please copy in myself and Cllr Michael Haley.

At this stage I believe Cllr Brookes has just misunderstood the Standing Orders and Financial Regulation and once these matters have been addressed I would suggest the matter is considered closed.

All communications in regard to this matter should be copied to Cllr Brookes, Cllr Haley and myself, I want to ensure that we have 100% transparency, no other members need to be involved at this stage in my opinion.

At each meeting Councillor Haley presents all members with these single sided
printed report which contain little substance as to what is going on with the
Oakham Neighbourhood Plan.

Looking at the reports I can see the working group is heading for a huge budget overspend.
of at least £4330,00 this fiscal year.

We are told the working group is hoping Rutland County Council will not invoice
for services ordered this year until the start of the next fiscal year.
Fingers crossed they won't. or the budget over spend may be 100% or more
the reports do not show all the working groups expenditure.

I would like to know why Cllr Michael Haley and the group is permitted to place an order
with Rutland County Council when the group does not have the money in their
budget and why he thinks it is acceptable to gamble that the group may receive
the invoice and the money to pay from next years money?

I also believe that paying Rutland County Council for Consultancy
is a serious conflict of interest, Due to them constantly and incorrectly
stating that Neighbourhood Plans should mirror their own local plans.

Uppingham Town Councils high court judgment proved this comment is not true.

From the report below the council decided and I am not sure how?

to approve the request of £1000 from Cllr Michael Haley for the Neighbourhood Plan
Steering Group.

The Steering group is a working group of the council meant to be community led.

It appears to be the only council working group that does not need to produce a
proper budget.

When it was formed an amount for a budget was guessed, that guess was
far to low and the NP is now quite a lot over budget.

I don't think the council has approved enough expenditure and the £1000 is just
another low guess.

for example if all residents use their prepaid envelope to return the survey
Oakham Town Council will receive a postage bill of nearly £4000
which the council has not approved.

It was said the council council could not budget for postage because they did not
know how many people would return surveys in the prepaid envelope.

I have attempted to explain if we approved the full amount and people did not
use them then the it did not matter that the expenditure was less than the approved
amount. It would matter if it was more.

From what I can work out from the report Cllr Haley who was on holiday
was seeking £757 for printing and a guess of return postage costs.
The council has guess that would be £243.00 meaning 405 out of the 6500
printed and some how delivered.
A very poor expected return.
It is expected that everyone else will use drop of point in the town.
Cllr Richard Haynes a member of the steering group said they expect less than
half the surveys would be returned.

I also pointed out at the same meeting the council had not seen the survey
so if residents asked Cllrs questions we would not be of any help to them.
