Married with a great Barbecue and live music throughout the Cider and Sausage festival, the atmosphere changes depending upon the time of day from relaxed and chilled during the day to vibrant and fun each evening as the party goers join in. There is always something for everyone.

Annually during the May Bank Holiday we go a wee bit ‘Wurzel’ and host our Cider and Sausage Festival. Featuring 40 real ciders straight from the barrel and locally crafted sausages including our own Pork and Ale, this is another lively Festival full of great music.

Oakham Town Council 2017 - 2016 Accounts Objections

Dear Oakham Town Council

I am obliged to notify you of my following objections which I am raising with the external auditor.

1. The 2016 - 2017 internal audit report is incorrect, the last page of comments from the internal auditor
is the same as 2015 -2016 and dated 10th June 2016

The report although it appears to be signed by the external auditor is it is not dated.


2. I will be objecting to the two electronic payments made totally £18,000
When I asked to inspect the accounts the council refused by right denying me my
right as an elector, The Clerk has ticked box 4 on the return saying those rights were given.
Eventually I was provided with a bank statement to show the transactions with the
recipients name crossed out. I obtained copies of all the exempt minutes of meeting
Cllr Adam Lowe unlawfully excluded* me from and I can find no minute were the council
gives the its authority for this sum to be paid. The council is required by law to separately
approve all payments over £5000 and there is no evidence of this being done the
minutes simply state the council will pay the former clerk the sum of money he wants.


3. I will be object to the £1000 paid in a lump sum to the Chairman Cllr Adam Lowe
are own regulations state this money should be paid monthly upon the office receiving
receipts.


4. I will also be objecting to the money paid to replace the bandstand railing as this
was not approved by full council.
I accept the initial work to make the bandstand safe falls within the authority
of the Clerks powers. Replacement of the Railing many months later did not
fall within that.


5. I will also be objecting to Cllr Michael Haley's agreement to right of a substantial
debt from a former tenant, when the council own solicitor wrote mediation is part of the
process we have to go through and the former tenant had no case not to pay the
full debt due.

I will be asking the auditor to look into the allegation made by former councillors
that there is a slush fund most members do not know about.

I request this email is attached to the minutes of the extraordinary meeting
of the council Wednesday 24th May 2017 as part of my objection to
the accounts, annual governance statement and the annual return.

*Unlawfully excluded a recent conduct investigation found that I had not breach the
code of conduct when Cllr Adam Lowe excluded me.

The same applies when former Cllr Alf Dewis did the same when I tried to raise
questions about end of year accounts which he was eventually found to have
acted unlawfully.

I hope at the next meeting Cllr Michael Haley is going to permit me to speak
without interruption and without the constant threat of unlawful exclusion
from meetings.

Why have we been provided with an internal audit report for next weeks extra meeting, Titled Year ending 31 March 2017

Signed and dated 15th June 2016.

The last page of the report thanks the former Clerk Richard White for his help
and Cllr Michael Elliot who resigned in August 2015

The internal audit report states the temporary clerks invoices are approved by council I have never
seen an invoice.

The law is very clear and the council continues to ignore it.

The council first broke the law when it employed self employed administrator
Tracy Haliday. When I raised that issue The then Chairman Cllr Adam Lowe said
it would be sorted.

This week we have been given a copy of the internal audit report which states
are temp clerk is self employed.

The council has been mislead by the then chairman Adam Lowe.

We have always been told we were employing the clerk.

I have written to the council and will raise my concern at next weeks special
meeting.

I have read the internal audit report and I am shocked to read the Locum Clerk is self employed.

The council is fully aware that it is unlawful for us to employ self employed Clerks or staff.

I thought it was only the temp admin was self employed and The then Chairman Adam Lowe
said it was being sorted.

It has been unlawful for any clerk to be self employed since 2011


New guidance says self-employment cannot be considered

Parish clerks will no longer be considered by HMRC to be self-employed and must be subject to PAYE. Guidance in Employment Income Manual EIM67320 had stated it was acceptable practice to treat payments received from the parish council as self-employed income
The Revenue says its view was based on the premise that payments to clerks fell below the PAYE tax threshold – but the department is now aware that many individuals’ earnings are above the thresholds of PAYE and National Insurance (NI) contributions.
New guidance has been issued on the tax treatment of parish clerks. It states that as a parish clerk is an office holder, income arising from the position is subject to PAYE, meaning a clerk
•    can never be considered self-employed for tax or NI purposes
•    must not be paid gross; and
•    must be taxed under PAYE.
Parish councils must register as an employer with the taxman and operate PAYE on the income earned by clerks. The new guidance adds that ‘any previous agreements with HMRC or the former Inland Revenue under which the clerk was paid gross or was treated as self-employed are void, as are any “inherited arrangements” under which a clerk’s income is not subjected to PAYE’.
To ensure a correct tax code is issued, HMRC must be advised – usually via form P46 – if a clerk has other income.
The department says it will carry out checks to ascertain whether councils are operating PAYE on clerks. They will be undertaken in the tax year starting 6 April 2011.
The guidance in EIM67320 has been removed and should no longer be followed.
