Planning Obligations and Developer Contributions SPD 

Consultation on Draft Revised Supplementary Planning Document
Rutland County Council is seeking views on a Draft Revised Supplementary Planning Document (SPD) on Planning Obligations. 
It is intended that this guidance will supplement the policies in the Council's adopted Local Plan and provide more detailed guidance to applicants for planning permission.
The document will apply alongside the the Council's CIL and replace the existing SPD on Planning Obligations and Developer Contributions that was previously adopted by the Council in 2010 (see below). 
Copies of the consultation documents may be viewed and downloaded below and are available for inspection at public libraries in Rutland during normal opening hours.
Comments on the SPD must be made during the consultation period starting on Friday 15 May 2015 and ending at 4.15 pm on Friday 26 June 2015.

    The draft SPD is closely linked to the Council's proposals to establish a Community Infrastructure Levy (CIL) in Rutland.  Other linked documents of particular relevance to the draft revised SPD are available to view on the Council's CIL web page (click to view).

    Adopted Supplementary Planning Document on Planning Obligations
    Rutland County Council has produced a Planning Obligations and Developer Contributions Supplementary Planning Document (SPD) that was adopted by the Council on 14th June 2010. The SPD outlines Rutland County Council’s approach to planning obligation policies and requirements for most developer contributions in relation to new development.

    The Council currently has policies in the adopted Core Strategy DPD which relate to the provision of developer contributionsThis SPD provides supplementary guidance to the Core Strategy.

    Developer contribution agreements can be either a unilateral agreement or mutual agreement. Examples of agreements can be viewed and downloaded from below.

    The guidance notes on the Council's priorities in negotiating Planning Obligations and Developer Contributions were adopted by the Council on 14th June 2010.

    Copies of the SPD may be viewed at Rutland County Council Offices and at Oakham, Uppingham, Ketton and Ryhall Libraries during normal opening hours.

    Revised Policy Guidance
    Following changes to Planning Practice Guidance issued by the government on 28 November 2014, local authorities may no longer seek developer contributions for affordable housing and tariff-style planning obligations towards community facilities and services from small-scale and self-build development, as defined in the guidance.
    Accordingly, the Council no longer requires S106 affordable housing or tariff-based S106 contributions in the following circumstances:
    • In the parishes of Oakham and Uppingham, developments of 10 units or fewer units and which have a maximum combined gross floorspace of no more than 1,000 m2;
    • In the remaining “rural” parishes of the County, housing developments of 5 units or fewer units (unless it is a rural exception site). In these rural parishes, where a site is of 6-10 units, developer contributions will be sought in the form of cash payments which are commuted until after the completion of units within the development.
