Oakham Town Council Acting Clerk Malcolm Plumb Abusing Powers To Pay For Cllrs And Ex Mayors Legal Advice???

Dear Oakham Town Council.

At last nights meeting the acting Clerk read out a prepared statement, I believe he mislead the council and is also abusing
his powers

1. Under the provisions of the Town Councils Financial regulations, the Clerk to the Council is empowered to spend up to
£500 with out the prior authority of the Town Council where urgent Council business needs to be transacted.

This  case does not fall within the catorgary of Urgent. Just because the chaiman and his mate the disgraced ex mayor
dont like my public comment or observations does not warrant the clerk spending any money. If either Cllr Dewis
and ex Cllr Dewis did serve legal action against the town council then that would be the time for the clerk to seek
formal permission to pay for legal advice.

It is my understanding the money may not being used to seek legal advice for the council it is intended to use the money
so that Cllr Adam Lowe and the Former Mayor Alf Dewis can obtain free legal advice and this is very wrong.

whilst I was in the office Alf Dewis telephoned the council to discuss this authorisation and to speak to Adam Lowe
the assistant clerk asked Alf Dewis to stop talking and she would call him back.
At this point I said it is wrong for the council to pay for his and Adam Lowes legal advice and the Clerk Mr Plumb
became annoyed.

The local government act and localism act forbids the precept from being spent on indviduals or Councillors
I have reported this matter to Leicestershire Police.

I have also reported again Oakham Town Partnership for their conspiracy to defraud Oakham Town Council
last year.

If Leicestershire Police had not taken the decission not to take further action, becasue Oakham Town Council had not lost the money due
to the cautious aprroach of our ex Clerk and Rutland County Council insisting the money was paid to Oakham Town Council
and not the partnership.

Cllr Adam Lowe publically supported the ex Mayors unlawful conduct when he resigned last year so it is no surprise
he is supporting this current matter which the council should not be funding.

I have sent a full statement to the councils solicitor.

I also telephoned Setfords Solictors and left a voicemail for Simon Conway

In that voice mail I pointed out the council has not given lawful authority for any expenditure.
The show of hands was not as the Chairman said a informal vote top approve the expenditure.
All none urgent expenditure like this has to be approved by full council formally, I would suggest
the clerk knows that and by bringing it to council for informal approval just justifies his wrongful
action in his own mind.
The Clerks report agenda item is not the place in meetings for this type of activity.

I also told Mr Conway why the former Mayor Alf Dewis resigned. That was for similar unlawful
conduct refered to in the Grant Thornton Audit Report and into unlawfully spending
with solicitors Wilkin Chapman by him.

It is my opinion that The Clerk and Chairman have put members in a very difficult position by asking
them to show support for unlawful expenditure but not approving it formally.

Tesco Instore Photographic Policy Has Changed.

For many years I have taken photographs and made videos in our local Tesco Store here
in Oakham.

Of just showing seasonal products and charity events run by the store.

So you can imagine my disappointment today after my shopping trip to spend my clubcard
vouchers I here my name called out by Bernic Loudon the store compliance manager as I am
leaving the store. I turned and saw her with the security guard. I asked what I had done wrong
in a friendly manner.

After last nights dreadful council meeting I was feeling very tired today and decided not to go to
the self service checkout as a normally do and went to a checkout operated by one one the best
members of staff. So as far as I knew nothing was wrong and complied with her request to return
to the door way.

Once there I was told I must no longer take photographs in the store, I explained I thought
Tesco had no problem with customers taking photographs instore.
She said it was against store policy and I would be banned from the store if I took photographs
again.

 The security guard added he had never had a problem with me but the current management
do.

Bernice then said I could take photographs of empty shelves and from that comment
I got to the bottom of the issue, The management do not like the blog post below.
If they have a problem then they should have spoken to me in store and not stop out side as
if I had stolen a bottle of gin or something. Especially as I had not taken any photographs
during today's visit.

I telephoned Tesco HQ and they told me they have change their policy regarding photographs
instore, customers can take photograph as long as they seek management consent. I don't think
I will bother.

I forgot to mention in the offending post whilst Tesco was subject to supply issues our new Aldi had was stocked with wonderful reasonable priced fresh fruit and vegetables.

Tesco Oakham Rutland Fruit and Vegetables Shortages

Shortages due to poor weather in supplying countries like Spain.

Whilst shopping at Tesco yesterday I could not help notice how popular many salad items had become and its only February.

Notices say it due to supply problems.

Other reasons could be due to panic buying as customers fill their trolleys as soon as staff fill the empty shelves.

One customer said "you must grab it when you can"

As far as I know Tesco does not stock long life fruit and vegetables, I am guessing a lot of plastic bags are going to sit in people fridges until they pop them into the bin to join the mountain that is dealt with each week throughout the world

I recorded the comment but wont publish as I don't want the taxpayers burdened with another
huge bill for another conduct investigation.

The assistant Clerk said she was not being rude, I think she was being rude in a moment of frustration
antagonised by the Mayor when I was having a chat about not being able to approve minutes if we
had not had sight of the exempt minute, I sensed Adam enjoys making a small thing a big issue.

Because the clerk came out of the office and said the minute should have been sent to all members
and was going to be circulated in the meeting.

It has taken months for the council to agree to do this. It is so frustrating.

I also asked the Clerk does this mean I can see all the exempt minutes since he has acted
as our clerk and he said yes if I send him a email request.
Fortunately I also recorded that agreement.

Despite the dreadful meeting things are slowly proceeding in the right direction,

A member of the public attended and gave a public deputation and she stated she had never
experience so much animosity. I turned and said it is always like this.

I actually believe that the majority of members actually really do hate me, which is very sad.

As this month is Gay History Month and I feel as if Rutland does not acknowledge it
as much if at all, like other local authorities. I decided to take a small LGBT flag
to Oakham Town Councils meeting.

Cllr Joyce Lucas BEM reacted in a way that made me feel quite upset.
When I placed the flag in a glass she mumbled and tutted and left the chamber.
When she returned to the council chamber and mumble something else as she
placed a small union flack in her glass, I asked politely what did you say?
She responded with you heard. I have replayed my audio recording and unfortunately
so many people are talking I could only here the end of her comment ...... I don't want
to be near you.

In the past Cllr Joyce Lucas has expressed her opinion by telling me that I was wrong
to celebrate my birthday in a gay bar with friends at it was wrong for me to share those
photographs on my blog, because I was bringing the council and position of Cllr into disrepute.
Those remarks also caused me a great deal of upset and offence.

The Chairman Adam Lowe acknowledge the flag and had no issue with them.
When Adam once told me the council did not like gay people he was partially correct
because I do not think that is true of all the members.

I wonder if there is an organisation that can educate those in public office here in
Rutland after all it is 2017























Cllr Joyce Lucas appears to be unwell at the moment but that is no excuse.
at the start of the meeting she stood and gave a statement rubbing her eyes.
Stating she was not crying and was fit to drive and she needed to state this
before the blogger clearly referring to me blogged otherwise. I wont comment
as I not a medical expert but when I get around to publishing the meeting video
people can make up their own mind and also note the random comments she make
towards me through out the meeting and the hand gesture or is wonderful.

The Town Council has voted not to take over the cemetery and will No longer pay any money towards the upkeep of the cemetery.

During the exempt Item about the cemetery which the chairman has now ruled is not exempt, I can confirm part of our 
conervasation was shared at the meeting I told the council you said if we walked away from the cemetery "people would 
question the purpose of the town council" I agree with this comment. I also said you felt "Cllr Michael Haley did not 
like you." at some point I said you felt "the council should grow up" Which I also agree with.

The Mayor Cllr Adam Lowe asked me to confirm this in a email which I am happy to do
other comments relating to the council I have made on my blog are my opinion and not yours.

It is public knowledge that this is not the first time you have raised concerns I referred to the letter you sent
last year to the council and pointed out the councillor were breaching the code of conduct during meetings
about the cemetery.

The Town Council has voted not to take over the cemetery and will No longer pay any money towards the upkeep of the cemetery.
I believe this to be an appalling decision.

Tomorrow I will publish the agenda report once I have change the paper from red to white as the chairman ruled it is no
longer exempt.

Between 07/02/2017 17:00 & 08/02/2017 07:55 a secured vehicle was stolen from a private car park in West Road, Oakham. The vehicle is a Dark Blue Fiat Multipla and had 4 x stickers on it saying ‘Volunteer Driver’. There are currently no identifiable suspects, witnesses or CCTV.

On 06/02/2017 at 13:00 a distraction burglary was carried out at a dwelling in Chestnut Road, Oakham. Suspects x 2 knocked on the door and stated they were from the water board. When the door was opened they pushed past the occupant. Once inside a search was carried out. It is not believed at this time that any property was stolen. Enquiries are currently ongoing.

Since the last Neighbourhood watch brief we have had one report of the theft of a motor bike from Morcott Road, Wing. The bike was left at the side of the house with the steering lock on. This incident occurred between 01/02/2017 18:12 & /02/2017 21:30.

There have been further reports of vehicles being damaged in Stockerston Road & High St West, Uppingham. These link to the reports of criminal damage last week.

One report of a burglary non-dwelling to a secured barn in Teigh Road, Ashwell. Entry was gained by cutting 2 x locks and property was stolen. This incident occurred between 01/02/2017 10:00 & 04/02/2017 11:35.

One report of theft from a secured vehicle in Main Road, Glaston. Persons unknown had smashed the driver’s side rear window to gain entry and a purse was stolen. This incident occurred between 04/02/2017 19:00 & 05/02/2017 03:00.

One report of criminal damage to fences in Grantham Lane, Empingham. Possible Hare Coursing. This incident occurred on 04/02/2017 at 16:52.

One report of theft from a driveway in Calder Close, Oakham. During material times persons unknown stole bathroom furniture. This incident occurred between 03/02/2017 12:00 & 03/02/2017 13:00.

Rutland County Council employed a monitoring officer without the required qualifications
The late Roger Begy said they don't need qualifications.

I disagreed and this current mess at Oakham Town Council is the reason why.
however nice the monitoring officer is she has not got a clue about how to investigate anything.
Fortunately unlike our chairman and Mayor Adam she recognises this is a serious matter.
And as for our Mayor Cllr Adam Lowe refusing to give the minutes and name those involved makes
him just as guilty as them.



Dear Mrs Mogg. Monitoring Officer

I have had another think about my complaint about Cllr Lowe and the Oakham Town Partnership £31,000 invoice.

I am pleased you recognise this is a serious matter. Cllr Lowe describes it in a email as a storm in a tea cup and does not 
feel this is a serious matter.

I was hoping by sending the conduct complaint based on the little bit of information I had you would
kick start an investigation.

Cllr Lowe has now stated he is named in minutes which did not exist at the point our agenda was published for 
this evenings meeting. He also said there are names of other councillors included in the minutes, he is refusing to
provide a copy of the minutes or name the others.

One or more of those named in the minutes has acted unlawfully and acted without the authority of the full council 
and incurred illegal expenditure.

If Councillor Lowe says he did nothing wrong, keeping quiet if you know who is responsible is doing something wrong
and just as serious as if he had actually agreed the spending without the authority of the council.

I think all those involved in meetings should remember the Nolan Principles of those who hold public office

Lying or covering for the guilty is a breach of those principles, 

Cllr Vince Howard told me there are people lying on the council, if they are they should go.

As the monitoring officer I would like you to investigate and find out why councillors have acted in this way.
since 2013 according to a letter sent to Oakham Town Council by a member of your staff last year.

Cllr Lowe is named in that letter.

I don't think it is unreasonable to ask why members in the know kept the knowledge of the Hawksmead money
from the council.  Although the reason is known The Former Chairman of the partnership and Oakham Town Councillor
Alf Dewis wanted all the money to be paid direct to the partnership. Leicestershire Police said if this aim had been achieved
then a fraud would have been committed. So I agree with you this a very serious matter and if not sorted Cllr Lowes tea
cup might sink.
