Martin Brookes Oakham Town Council and Standards For England


This week I received a transcript of my final statement relating to the ridiculous volume complaints made against me by Rutland Chat Room members and Oakham Town Councillors and their friends.

And the sole complaint RCC allowed to be passed to Standards For England regarding Cllr Joyce Lucas Conduct. (I am told she is a Liberal Democrat and this is why it allowed to be investigated none of my complaint against any of the Tory mob have been dealt with correctly)

It is clear from Standards questions from day one Oakham Town Council were not going to accept me as a Councillor and the friends like Mr Beech who asked the Town Clerk Richard White what he was going to do to get rid of me. I  don’t know what he expected them to do as at the same time he had raised five complaints against members because they he say showed him no respect when he came begging £12,000 from the council to set up another boys club with tax payers money.

Despite finding out Councillors told Standards they did not trust me and that is why they obstructed me, (Who do they think they are?) I continue to give up hours of my time to assist with the investigation.

I said I would be open as far as the law will allow with what I can publish.

So here are photograph of  my two statements.

These people have cost the tax payer a huge sum of money, just to stop me being a Councillor.

I still question why they did not stand some one of their thick friends like Cllr Dewis against me.
Surely that would have been cheaper.

And why did Rutland County Council call me in to a private meeting with Mr Pook and the head of corporate service days before the deadline for candidates? They were also able to remove postings attacking me on the Rutland Chat Forum when I said I would complain to the electoral commission.

Although it looks a lot of text it is

Cllr Joyce Lucas Oakham Town Council

The draft findings of complaint made against Cllr Joyce Lucas has been drawn up, the law prevents me from publishing it!

Although I will say when I complain about the so called respectable people of Oakham for calling me a paedophile I am not imagining it as the like to tell people.

Because in her Statement Cllr Lucas says she does not use the word but she has heard other people refer to Mr Brookes as a paedophile.

As a Cllr why does she not challenge this?

It is disgusting Ex Mayors and Ex Cllrs can spread this very damaging description of me.

It is totally unacceptable these people are real old style Tory Scum I imagine unique to Rutland, they have wrapped the local police around there fingers The Town Councils Clerk says its nothing to do with Oakham Town Council of course it is, he is stressed they call him a wimp for not supporting them anymore. 

Nasty Vile people like Mr Tyers use there age when speaking to local police 'I am a 80 year old man I would not behave like he says' We all see the news and old gits like Tyers, Beech, Harrison and Kelly to name a few are much fitter these days and are often issued ASBO's so don't try that one Tyers. 

I hope when your gone the next generation of Rutland so called dignitaries don't mirror your behaviours

And why is Councillor Lucas so concerened that I seemed to 'wander round on my own' hope she not going to kiss me again!

Oakham Town Council Police give adive

Cllr Charles Haworth complained to police after Cllr Martin Brookes, (as I was then) sent him an SMS message addressed to the f*t sh*t. Before I resigned as a councillor. I have chose to accept advice from Leicestershire Police. It is not normal for me to send this type of message, this was due to exceptional circumstances. I wont apologise to any Oakham Town Councillor, although I am not proud of  my actions that evening.

Another Town Councillor Joyce Lucas has been pressing the police to take action, after I photographed her illegally parked in the town and posting the image on this blog.

She falsely accused me of hiding and laying in wait photograph her. Police should be charging her with wasting their time.

Members of the dysfunctional authority (Rutland County Standards description not mine) have also complained to the police regarding the content of my blog this week, I published details of the complaints made against me by all Councillors. They are happy to make my life difficult as long as the public don't know.

Fortunately Oakham Town Council do not control Leicestershire police yet!

This morning I received another large pile of papers from Standards for England.

Enclosed is a complete package of the allegations made by Mr Jim Harrison, Councillor Charles Haworth, Mr Alan Kelly, Councillor Alf Dewis, Mrs Doris Cook, Mr Paul Beech and Richard White.

Although Standards have accepted the case for investigation they assure me they have not yet formed a be view.

The whole process is going to take a long time and cost will be huge.

Standards for England Expect all interviews to be conducted by the 2nd September 2010
A Draft finding will be issued by October 7th 2010
and the finding should be issued by the 4th November 2010

Maybe Rutland County is hoping I will be put on the bonfire the next day.

It is interesting to see ex councillors links to Senior Rutland County Councillors, Cllr Heather Wells and Cllr Peter Jones were amongst those to receive copies of the complaints.

I always said there was a Tory link as far up as Rutland County Council.

Oakham Town Council Harassment


All the above is real harassment, all the letters photographed represent some of the harrasment I have been subjected to before and after my election to the dysfunctional authority known as Oakham Town Council.



All these letters were recieved over a two day period.

All relating to complaints from

I am not sure what these people think they will achieve, Cllr Haworth and ex Cllr Beech have the cheek to go hand in hand to the police and ask them to issue a stage 1 harassment order against me.

I read Mr Harrison's Blog and look back at the comments made by Mr Beech online and think I should do the same but some how I don't even think Oakham police will assist.

Oakham Town Council support harassment, bullying, intimidation and homophobic behaviour, I don't use the homophobic tag for no good reason. The events that followed my birthday party were clearly homophobic. Also more recently the despicable actions of Cllr Lucas.

How can a photograph of a drag artist on my blog bring the position of Councillor and the Council into
disrepute. I can wait see the bigoted reaction of Cllrs Dewis and Lucas. After they see my blog about London Pride at the weekend.


Rutland County Council also support the same.

Homophobic Oakham Town Council

Homophobic bigots Cllr Alf Dewis and Council Alf Dewis supported by Rutland County Council get the green light from Standards for England to continue their homophobic harassment and bullying.

Although I did notice an improvement in Cllr Dewis's behaviour at the last Town Council meeting I fear he will see this as a victory.

Cllr Dewis is a member of a police committee so no action was taken when I made a compliant of assault despite at least 3 other people being present no one saw anything




As for the vile evil Cllr Joyce Lucas she will continue to spread her nasty disgusting untrue statements against me.

On 22nd April 2010, the assessment sub-committee of Rutland County Councils standards committee decided to refer the above allegation to Standards for England. It was received by Standards for England on 16 June 2010.

The allegation is summarised in the authority's decision notice.

Decision

When a standards committee refers an allegation to Standards for England, it must make one of three decisions.

refer the case to one of its ethical standards officers;

refer the allegation back to the standards committee of the relevant authority; or

take no further action.

Having carefully considered the information provided to it, Standards for England has decided, in accordance with section 58(2) of the local government act 2000, as amended, to take no further action.


Reason for decision

The matters in the allegation relate to an informal meeting which took place between the complainant and Councillors  Lucas and Dewis. It is alleged that Councillors  Lucas and Dewis accused the complainant of bringing the council into disrepute by posting photo of his birthday celebrations on a blog where he is identifiable as a councillor. The complainant has alleged that this is homophobic.

based on the evidence referred to Standards for England, it would be very unlikely that the actions, even proven, would amount to a breach of the Code of Conduct.



I have received a private email relating today's posts, questioning why I have not published details of the allegations against me. I have nothing to hide and as soon as I can I will publish full details.


All the allegations are from Oakham Town Councillor past and present and they have all been referred by Standards for England for further investigation.


So far seven complaints have been referred all relating to this blog and links on my facebook group.

Decision

take no further action.

Information about the complaints is considered confidential throughout  the investigations, even after the investigation is completed there are restrictions on what can be published. It is my understanding I can not publish details of the complaints made by the complainants, they can if they wish. I think most people who follow my blog will know who they and their complaints.

Reason for decision


The complainant has alledged that the subject member has breached the Code by goading the complainant and accusing him of stealing at a meeting of Oakham Town Council.

No details are provided of the date of the meeting of the Town Council. The subject member is member is alleged to have asked why the complainant sat next to him and, at the end of the meeting, accused the complainant of stealing from the Town Council. No further details are provided of the subject members conduct.

(I provided full details to RCC strange this has gone astray maybe to police officer present can assist  many people saw his conduct and my angry response towards the vile bully)

Whilst an unfounded accusation about "stealing " may constitute disreputable behaviour on behalf of a member, in the absence of any supporting details about the alleged conduct I do not consider that any breach of the code is disclosed on behalf of the subject member

I have decided to take no further action in relation to this allegation.

The complainant has alledged that the subject member has breached the Code by goading the complainant and speaking to him in an intimidating manner.

The alleged conduct occurred during the annaul general meeting of Rutland County Council, but both attended the meeting as "observers". Neither are members of the County Council, but both are members of Oakham Town Council.

There is no evidence that either the complainant or subject member were attending the County Council meeting in their capacity as members of the Town Council, or that by doing so they were acting, claiming or giving the impression of acting as members of the Town Council. I do not consider therefore that the code if conduct applies inrelation to the alledged behaviour of the subject member.

Furthermore, the complainant's letter refers to the subject member speaking to him in an "intimidating and childish manner", that he tried to "provoke" the complainant and that the subject member's behaviour was "harassing" the complainant. No further details are provided of the alleged conduct.

I do not consider that the code applies to the subject member's conduct, nor that any breach of the code is disclosed on behalf of the subject member.

I have decided to take no further action in relation to this allegation.
Standards for England investigations.


I have received a large quantity of letters from Standards of England.
It is very clear Rutland County Council have not handled any my complaints correctly.
This has given members the green light for them to continue.
It appear Rutland County Council left out important details such as dates of meetings and supporting details.

What a surprise!

All complaints from councillors and ex councillor and friends have been referred for further investigations.

I am pleased to see Rutland County Council has provided all the required information.
Although they sometimes refer to Mr Wright instead of Mr White.

There has been much local discussion, regarding the cost of these investigations the people making the complaints are happy for the public to believe I have raised all the complaints and I am wasting a lot of peoples time and money.

I hope standards for England will recognise the reason for these complaints made against me are malicious and have mainly arisen because the complainants support the members who resigned when I was elected.

I am not sure what they feel they can achieve, the internet activities have suggested the stocks extra hole should be used. Fortunately Standards for England don't have those powers.

I have noticed their friends have started to remove hate content from facebook. I can only assume this is to help their cause.
I find it very frustrating this often happens after I have spoken to Richard White, who tells me he does not know the people. It is clear that in this case he knows people who post this rubbish.

Of course ex Cllr Mr Harrison is such a bully, he has no fear admitting he is responsible for his blog and content. He posts suggesting I am a risk to children. He is a nasty vile man. (another complaint to standards on it way?)

The list of complaints from Councillors and ex Councillors is huge.

If correctly investigated by Standards for England this will take up hours of my time and others. Time I am not sure I am willing to give.
I have already given up a huge amount of my time sitting at the table in the council chamber being ignored as is clearly now shown within last weeks minutes amendments. Although the last meeting things slightly improved it is clear it was hard for some members of this dysfunctional council to follow correct procedure.

I will be posting the findings of my complaints and let the public read and make up their own minds.

Rutland Times Standards Letter Writer

In a recent comment on my Blog I was accused of making many standards complaints.

I believe this is unfair. I think you will agree as you read on.

A former councillor attends meetings and has made it known to me there has not been a single meeting where there has not been a serious breach of standing orders.

when one of these incidents was passed to the Town Clerk his response was I wish people would not keep complaining about little things. It is the little things that are meant to keep the big thing running smoothly.

A resident wrote to last weeks Rutland Times, very concerned about the level of complaints aimed at Oakham Town Council.

He may get the feeling they are all from me, wrong information was leaked to Rutland Radio, who broadcast my name until the press office of Rutland County Council asked them to withdraw the news item.

The writer of the letter says he may use the freedom of information act to find details of the complaints. If that works I would like to know.

Complaints are handled in a very secret way. Minutes of Rutland County Councils Standards Committee are available, unfortunately the only contain the basic details with no names.

I would like to see all complaints dealt with publicly I would like to publish all details unfortunately the local government act forbids that. If complaints are investigated by Standard for England the law only allows the publication of the finding and this most likely wont contain the complainants name.

Without intentional breaking the law I publish the following information.

If a person wishes to complain about a councillor in Rutland they write to the monitoring officer at Rutland Council,

If a complaint is made about a councillor, they will not know for some time unless they are in contact with members of the standards committee or if the complainant informs you.

In my case the first I knew anything about the many complaints about me was after a I received a large delivery of letters.

Rutland County Councils Assessment Sub-Committee of the Standards Committee considered these allegations most from vile bullies, there maybe more I don't know.

Most Decisions I have received notice of state the following:

In accordance with Section 57A(2) of the Local government Act 2000, as amended, the Standards Committee Assessment Sub-Committee resolved to refer the allegation(s) to Standards for England for the following reasons:

This case taken together with other assessed cases involving many members of Oakham Town Council indicates  an inter-relationship of cases so serious or complex that they could not be handled locally;

Investigating the complaint(s) require substantial amounts of evidence beyond that available from the authority's documents, its members or officers;

There is substantial governance dysfunction in the authority,


In relation to the dysfunction without wishing to attack our chairman, she is trying very hard to bring harmony to our council with the assistance of her deputy.

The job is a difficult one handled with little or no training and hindered in my view by the bullies like Cllr Alf Dewis and Cllr Charles Haworth.

Cllr Dewis is a new Cllr and and for a new boy has risen very quickly within the council. I suggest he is trampling his way to the top.

Cllr Dewis has assaulted me and constantly obstructed me. He tells the police his raised  hand came into contact with me because I walked past him. The police support there committee member and no action is taken.

Only three complaints from myself have been referred to standards for England.

These complaints relate to 2 against Cllr Alf Dewis and  1 against Cllr Joyce Lucas

So Before anyone else says the cost is due to me look at the list please.

Oakham Town Council Standards Complaints

This morning I received another pile of papers from Rutland County Council.

It appear Rutland County Council work backwards.

I have to still receive information relating to my complaints made last year and early this year.

This morning I find the follwing complaints have been refered to Standards.

Four complaints made by ex Cllr Paul Beech, ex Cllr Alan Kelly, Oakham Town Clerk Richard White and Melton street warden Doris Cook.

A nice little group of thugs and bullies now where is Mr Tyers complaint.

All the complaint relate to my private blog.

When I became a Oakham Town Councillor I expected some crap but not as much as this.
These people would like to see me removed from the council, they may suceed but I believe the conduct of these people and the current members of the council will cause more damage than anything they think I could I do.

Until these people leave me alone and the town council remembers it is a council to serve the town I will keep blogging.

Do they think the public are stupid the public attend meetings and after each I am approached and concern is expressed at how I am treated as members.

Yes I do get annoyed at meetings and sometimes speak out of turn. I like all the others have received no training. Including the thug and bully Councillor Alf Dewis who attempts to trip me up at every oppertunity.

The sooner this council is abolished. the better.

These people try and stop me speaking out at every chance they can. They wrote to Rutland County Council suggesting I am banned from library computers. They succeeded in some way by seeking the removal of my flickr account. I receive many emails asking where my photographs have gone, they are not lost, I will not and can not afford to renew flickr surpringly one of there mates offered to pay. They silenced the local rag the Rutland Times, they are dissapointed Gary is leaving the Times to bigger and better things in Manchester. I am not sure how that happened because he seeemed lack any journalistic talent, although he was a nice person to chat with.

Whatever they complain about they wont get me to give up. Cllr Fillingham can knock back a few more bottles before she returns to council meetings.

All this stupid behaviour conducted by town councillors, friends and former councillors is having a huge effect on the running of the council. A council that cost the tax payer a fortune. The tax payer deserves better.

I am now convinced my acceptance onto the council was agreed because they though they could shut me up.
Well they were wrong I wont shut up until the bullying stops! the council takes notice of its standing orders.

I was told the new working group would be delayed set up to review procedures and standing orders because the council and was sending Richard White the Town Clerk for training. This was the first I heard of this allthough it is a good thing who decided this.

It is becoming very clear to me there are two councils one the public see chaired by Sharon Spencer and another behind closed doors run by the town clerk and a elite group of councillors.  doors that are firmly closed to me.

The most damming finding of this council is the descision published by The Standards Commitee at Rutland County Council. There is substantial governance dysfunction in the authority.

Personaly I don't mind the complaints against me what can they achieve, not much realy bad publicity for the town council. I am not paid to serve as a Cllr so no loss there. I hope the complaints will highlight the poor standards of the council and this will be corrected. You could say the council has shot itself in the foot for attacking me for over a year.

In addition two further complaints made by me regarding the bullying by Cllr Alf Dewis have also been refered to Standard of England.

I wonder if they will hurry up and investigate before Mr Cameron abolishes them.

After Recieving complaints from former Councillor Jim Harrison .
and Councillor Charles Haworth.

Considering Mr Haworths Complaint:The Sub-Committee decided there could be a possible breach of the code of conduct

Treating others with respect-paragraph 3(1)

Frankley this is a joke. I have never been treated with any respect by Mr Haworth or any of his mates.
The Standards Committee then go onto say:

This I find most annoying I made a complaint long before Mr Harrsons and have never been told the outcome.

The complaint has also been passed to Standards to England.

One of the complaints relates to my complaint, he complains I published details about the images he provided to the Rutland Chat Forum.

Even though he said sorry after, I traced the images to his photobucket account. If he was still a councillor I would be complaining about his current blog about me Jims Tea Break and its defamatory content. The nasty thug suggest I am a danger to young people. Standards for England will take his blog as evidence.


Two of my complaints have been refered to Standards for England.

The committee suggests councillor Alf Dewis may have breach the following code of conduct.

Treating others with respect - paragraph 3(1)
Bulling any person - paragraph 3(2)9b)


Pity it does not say homophobic bullying.

The Commitee refers my complaint against Cllr Joyce Lucas for the same reasons

I await the outcome of my complaints I made last year.

It was reported in the press a large number of complaints had been raised against Oakham Town Councillors.

I now know 6 have been made against me by Council members and ex Councillors

The other 35 are against other members some made by me and others from members of the public.

I am told some of the complaints against me have been referred for investigation to Standard for England

Complaints I made regarding the Town Clerk can not be considered by Standards. I am told the complaints should be handled by Oakham Town Council not much hope there!
